This DMCA Notice & Takedown Policy explains how to notify us of alleged copyright infringement under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”), and how account holders may submit a counter-notification.

1) Overview

We respect intellectual property rights and expect our users and partners to do the same. The Site primarily publishes news, commentary, and original reporting. If you believe material on the Site infringes your copyright, please follow the steps below.

2) Designated DMCA Agent

3) How to submit a DMCA notice (17 U.S.C. § 512(c)(3))

To be effective, your written notice must include all of the following:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
  3. Identification of the material that is claimed to be infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material (e.g., full URL(s)).
  4. Your contact information: name, postal address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is notauthorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Preferred format: one work per line; include exact URL(s); attach supporting materials if helpful.

4) What happens after we receive a notice

  • We will review your notice for completeness and may request additional information.
  • If the notice appears valid, we may remove or disable access to the material and notify the user who posted it (if applicable).
  • We may forward your notice—including your contact details—to the user or publish it (e.g., to a transparency database) where legally appropriate.

5) Counter-notification (17 U.S.C. § 512(g)(3))

If you believe your material was removed or disabled as a result of mistake or misidentification, send a written counter-notice to the Designated Agent. It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location where it appeared before removal (full URL).
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.
  4. Your name, postal address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if outside the U.S., the Federal District Court for the Northern District of California), and that you will accept service of process from the person who provided the original notice or an agent of that person.

Upon receipt of a valid counter-notice, we may restore the material in 10–14 business days unless the original claimant informs us that they have filed an action seeking a court order against you.

6) Repeat infringer policy

In appropriate circumstances, we terminate accounts or access for users who are determined to be repeat infringers. We also reserve the right to remove content at our discretion.

7) Misrepresentations (17 U.S.C. § 512(f))

Any person who knowingly makes a material misrepresentation that content or activity is infringing (or was removed by mistake) may be liable for damages, including costs and attorneys’ fees.

8) Scope & third-party content

This policy applies to content we host on our servers. We do not control and are not responsible for content on external sites linked from the Site. For infringements on third-party platforms, please contact those platforms directly.

9) Non-copyright issues

10) Changes to this policy

We may update this policy to reflect legal, technical, or business changes. When we make material changes, we will update the Effective date above and may provide additional notice.
